Please read these Terms & Conditions carefully before using theplaza.online. By accessing or using our website, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use this website.

1. About ThePlaza.online

ThePlaza.online is operated by ThePlaza Online (Pty) Ltd, a company registered in the Republic of South Africa (“ThePlaza”, “we”, “us”, or “our”). Our platform is an online multi-vendor marketplace that connects independent third-party sellers (“Vendors”) with buyers (“Customers”).

ThePlaza.online is a platform and venue only. We are not a seller, supplier, or party to any transaction concluded between a Customer and a Vendor. The contract of sale for any product listed on our platform is formed directly and exclusively between the Customer and the relevant Vendor.

2. Definitions

“Platform” means the theplaza.online website and all associated services.
“Vendor” means an independent third-party seller registered to list and sell products on the Platform.
“Customer” means any person who purchases or attempts to purchase products from a Vendor through the Platform.
“Listing” means a product or service advertised for sale by a Vendor on the Platform.
“Transaction” means a sale concluded between a Customer and a Vendor through the Platform.

3. Nature of the Platform — ThePlaza is Not the Seller

ThePlaza.online provides technology infrastructure, payment facilitation, and marketplace services. We do not manufacture, warehouse, inspect, or take title to any products listed on the Platform. Each Vendor is solely responsible for the accuracy of their product listings, pricing, stock availability, fulfilment, and delivery.

When you purchase from ThePlaza.online, you are purchasing from the individual Vendor identified on the product listing and checkout page — not from ThePlaza.online. Your contract of sale is with that Vendor.

ThePlaza.online shall not be liable for any loss, damage, injury, or disappointment suffered as a result of a Vendor’s failure to deliver, deliver late, deliver incorrect goods, or breach any obligation to the Customer, subject to the dispute and refund process described in Section 9 below.

4. User Accounts

To make purchases or register as a Vendor, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must provide accurate, current, and complete information at registration and update it as necessary. ThePlaza reserves the right to suspend or terminate accounts that violate these Terms.

You must be 18 years or older to create an account or make purchases on this Platform. By registering, you confirm that you are 18 years of age or older.

5. Vendor Listings and Product Information

Product listings, descriptions, images, prices, and availability are provided by Vendors and not verified by ThePlaza.online. ThePlaza makes no warranties as to the accuracy, completeness, or reliability of any product information. Customers should read all product descriptions carefully before purchasing.

ThePlaza reserves the right to remove any listing that violates our Listing Policy, applicable law, or these Terms, without notice to the Vendor.

6. Pricing and Payment

All prices are displayed in South African Rand (ZAR) and include VAT where applicable. Prices are set by Vendors and may change without notice. ThePlaza.online facilitates payment processing on behalf of Vendors through Paystack. Payment is due in full at the time of order. ThePlaza does not store your card details.

7. Delivery

Delivery of products is the sole responsibility of the Vendor. Estimated delivery timeframes are provided by Vendors and are not guaranteed by ThePlaza.online. ThePlaza.online uses The Courier Guy as a shipping partner; however, shipping arrangements are managed by Vendors and may vary.

ThePlaza.online is not responsible for delays caused by third-party couriers, incorrect delivery addresses, or Force Majeure events.

You will receive a tracking number from the Vendor once your order has been shipped. You can track your order at www.thecourierguy.co.za/tracking.

8. Consumer Rights Under the Consumer Protection Act

Customers who are consumers as defined in the Consumer Protection Act 68 of 2008 (“CPA”) retain all rights afforded to them under the CPA, including but not limited to the right to fair, honest dealing, the right to fair value, good quality and safety, and the right to fair and responsible marketing.

To the extent that any provision of these Terms conflicts with the CPA, the CPA shall prevail. Nothing in these Terms is intended to limit, exclude, or waive any right you may have under the CPA.

9. Disputes, Non-Delivery and Refunds

If you have not received your order within the expected delivery timeframe, or if goods received are materially different from what was described, you must notify us within 14 days of the expected delivery date by submitting a dispute through your account’s Order page.

Upon receiving a dispute, ThePlaza.online will:

  1. Contact the Vendor to confirm shipment and delivery status.
  2. Review tracking information provided by the courier.
  3. If non-delivery or material non-conformance is confirmed, issue a full refund to the Customer from funds held from the Vendor.
  4. Suspend or terminate the Vendor’s account if a pattern of non-delivery is identified.

Vendor earnings are held for a minimum of 14 days after order completion before being released for withdrawal. This holding period protects Customers and enables ThePlaza to action refunds from held funds where warranted.

Refunds are processed within 5–10 business days to the original payment method.

10. Returns

Return eligibility is determined by the Vendor’s individual return policy, which is displayed on their store page. Certain Vendors may not accept returns on specific product categories. Where a return is accepted, the Customer is responsible for return shipping costs unless the goods were incorrectly supplied or defective. Please refer to our Refund and Returns Policy for full details.

11. Intellectual Property

All content on the ThePlaza.online Platform — including the logo, website design, text, graphics, and software — is owned by or licensed to ThePlaza Online (Pty) Ltd and is protected by South African and international copyright law. You may not reproduce, distribute, or commercially exploit any content from this Platform without our prior written consent.

Vendors retain ownership of their product images and descriptions but grant ThePlaza.online a non-exclusive, royalty-free licence to display such content on the Platform for the purpose of facilitating sales.

12. Prohibited Conduct

You agree not to use this Platform to: engage in fraudulent activity; post false or misleading information; infringe any third party’s intellectual property rights; upload malicious code or software; scrape or harvest data without consent; or engage in any conduct that is unlawful under South African law.

13. Limitation of Liability

To the maximum extent permitted by law, ThePlaza.online shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or from any Transaction. ThePlaza.online’s total aggregate liability to you for any direct loss arising from your use of the Platform shall not exceed the total value of the Transaction giving rise to the claim.

Nothing in this clause limits liability that cannot be excluded under the Consumer Protection Act or any other applicable mandatory law.

14. Privacy

ThePlaza.online processes personal information in accordance with our Privacy Policy and the Protection of Personal Information Act 4 of 2013 (“POPIA”). By using the Platform, you consent to the collection and processing of your personal information as described in the Privacy Policy.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.

16. Changes to These Terms

ThePlaza.online reserves the right to update these Terms at any time. The updated Terms will be posted on this page with a revised “Last Updated” date. Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
